The Sedona Conference Institute (TSCI) presents the 2026 eDiscovery Negotiation Training: Practical Cooperative Strategies, a comprehensive program designed to enhance participants' skills in eDiscovery negotiation. This event is organized by The Sedona Conference, a nonprofit research and educational institute dedicated to advancing law and policy in areas such as antitrust law, complex litigation, intellectual property rights, and data security and privacy law.

The training focuses on practical cooperative strategies to avoid or resolve conflicts commonly encountered in the preservation, collection, production, and use of electronically stored information. Key topics include preservation, scope of discovery, form of production, privilege, social media, messaging apps, ephemeral data, and AI-generated content. The program employs a heavily participatory format, utilizing a litigation hypothetical, faculty demonstrations, and mock negotiation and hearing exercises to provide hands-on experience.

Participants will engage in three mock Rule 26(f) conferences and a mock Rule 16(b) case management conference, conducted in both breakout and plenary sessions. These exercises are supervised by experienced dialogue leaders, including veteran trial lawyers, eDiscovery experts, and judges, who provide valuable critique and personalized feedback. The program also offers opportunities for extensive dialogue with these experts, enhancing the learning experience.
