2020 eDiscovery Negotiation Training: Practical Cooperative Strategies

The 2020 eDiscovery Negotiation Training: Practical Cooperative Strategies was a specialized program designed to enhance participants' skills in negotiating eDiscovery processes. Organized by The Sedona Conference Institute, the event took place on February 12-13, 2020, at the offices of Paul Weiss in New York, NY. This training aimed to equip legal professionals with effective strategies to collaborate with opposing counsel, ensuring efficient and cost-effective fact-finding while minimizing disputes, in line with Rule 1 of the Federal Rules of Civil Procedure and attorneys' ethical obligations.

The program featured a highly participatory format, utilizing a litigation hypothetical, faculty demonstrations, and mock negotiation and hearing exercises. Participants engaged in three mock Rule 26(f) conferences focusing on the scope of discovery, preservation, form of production, privilege, and social media. Additionally, some attendees had the opportunity to participate in a mock Rule 16(b) case management conference, presided over by judicial faculty members. The experienced faculty, comprising veteran trial lawyers, eDiscovery experts, and judges, provided valuable critiques and facilitated discussions to enhance the attendees' negotiation skills.

Notable faculty members included Hon. Stewart D. Aaron, U.S. Magistrate Judge for the Southern District of New York; Hon. Maria A. Audero, U.S. Magistrate Judge for the Central District of California; and Chris Boehning, partner at Paul, Weiss, Rifkind, Wharton & Garrison LLP. Their combined expertise offered attendees diverse perspectives and insights into effective eDiscovery negotiation practices.

This training was particularly beneficial for legal professionals involved in litigation, including in-house counsel, outside counsel, and eDiscovery specialists. By participating, attendees gained practical skills to navigate eDiscovery negotiations more effectively, fostering cooperation and reducing conflicts in the discovery process.
