The Sedona Conference Institute (TSCI) presents the 2023 eDiscovery Negotiation Training: Practical Cooperative Strategies, a specialized program designed to enhance participants' skills in eDiscovery negotiation. Organized by The Sedona Conference, a nonprofit research and educational institute dedicated to advancing law and policy, this event brings together leading jurists, in-house counsel, outside counsel, and eDiscovery experts.

The program features a heavily participatory format, utilizing a litigation hypothetical, faculty demonstrations, and mock negotiation and hearing exercises. Participants will explore practical cooperative strategies to avoid or resolve conflicts commonly occurring in the preservation, collection, production, and use of electronically stored information. Under the supervision of experienced faculty, attendees will engage in mock Rule 26(f) conferences focusing on scope of discovery, form of production, preservation, privilege, and social media, as well as a mock Rule 16(b) case management conference.

This training offers personalized feedback and critique from faculty members, providing opportunities for one-on-one dialogue. The program is invitation-only to ensure a balanced and interactive experience, with mandatory advance preparation including a preparatory webinar and review of program materials. Participants are also assigned a teammate and faculty advisor for virtual meetings prior to the event.

Legal professionals involved in eDiscovery, including attorneys, in-house counsel, and legal support personnel, will benefit from attending this program. It offers practical training to enhance negotiation skills, ensuring efficient and cost-effective fact-finding while avoiding unnecessary disputes, consistent with the Federal Rules of Civil Procedure and ethical obligations of attorneys.
