The Federal Bar Association hosted a webinar titled "Litigating Data Breach Cases in 2025" on September 9, 2025. This event focused on recent developments in data breach and cybersecurity multidistrict litigation (MDL) cases across the United States, particularly in the District of Minnesota.

Key topics included Article III standing, choice of law issues, state statutory claims, case management strategies for large-scale cases, and the implementation of bellwether processes in class action data breach litigation. The panel featured prominent practitioners such as Karen Hanson Riebel, co-lead counsel for MDL 3108: Change Healthcare, Inc. Customer Data Security Breach Litigation and MDL 3083: In Re: MOVEit Customer Data Security Breach Litigation; Kate Baxter-Kauf, who argued motions to dismiss in both cases; and Emma Ritter Gordon, a Certified Information Privacy Professional (CIPP/US).

This webinar was particularly beneficial for legal professionals involved in data breach litigation, offering insights into current challenges and effective strategies in this evolving field.

Emma Ritter Gordon

Associate at Lockridge Grindal Nauen PLLP

Emma Ritter Gordon is an Associate at Lockridge Grindal Nauen PLLP practicing in the firm’s data-breach and healthcare groups. She represents consumers and healthcare providers in individual and class litigation. Since joining LGN, she has represented pro bono clients with criminal appeals before the Minnesota Court of Appeals. After graduating summa cum laude from Duke Law School, Emma clerked at the Eighth Circuit Court of Appeals for the Honorable Judge David R. Stras. At Duke, she served as the Senior Articles Editor for the Duke Law Journal and as Co-President of the Duke Law and Technology Society. She has interned at the Department of Justice in the Computer Crime and Intellectual Property Section and at the North Carolina Solicitor General’s Office. Before going to law school, Emma worked for a major healthcare technology company. She held a variety of roles in operational strategy, data analysis, and product management. Her experience working with large datasets of sensitive health data informs her approach to legal issues involving data privacy and cybersecurity.

Karen Hanson Riebel

Partner at Lockridge Grindal Nauen PLLP

Karen Hanson Riebel concentrates her practice in the areas of data breach, antitrust, and securities litigation. She has litigated a number of complex class action matters and represented numerous pension funds and other institutional investors in cases involving corporate fraud. Since 2013, she has been on the forefront of international data breach litigation, representing consumers and financial institutions against retailers, insurance companies, and software providers. Ms. Riebel began her career by spending seven months in Anchorage, Alaska as a member of the trial team that secured a jury verdict for punitive damages in the amount of $5 billion for a mandatory punitive damages class in In re The Exxon Valdez, Case No. A89-0095-CV (D. Alaska). For their efforts, Ms. Riebel and the other members of the trial team were awarded the Trial Lawyers’ For Public Justice Trial Lawyers of the Year award in 1994. Most recently, Ms. Riebel has served in leadership roles in data breach litigation involving Premera Blue Cross, Capital One, Yahoo!, and Progress (the MoveIt Data Breach). Ms. Riebel lives in Minneapolis with her husband and two children.
